為履行經常性義務而簽訂的連續性合同，是指重複重複相同內容的合同，而不是一次性或者一次性完成的合同。
例如，租賃合同和倉儲合同就屬於這一類。 租賃、貸款、消費信貸等連續性合同是出於使用、收入和標的物的目的，並且已經由接受者享有，不能歸還，因此不能恢復到原來的狀態。
非連續性合同，又稱臨時合同，是指一次性履行的合同。
也就是說，一次性付款將使合同的內容變現，例如銷售、贈與、合同和其他合同。
連續合同和非連續合同在追溯力方面有所不同：
當續約終止時，沒有恢復原狀的可能，或者不宜恢復原狀，因此續約的終止只在將來生效，終止前的合同關係不受影響;
非中續合同終止後，有恢復原狀的可能，並可發生溯及既往效力;
合同終止僅適用於連續性合同，即不能一次性清償債務而必須連續履行的合同，如租賃合同、合同合同、建設工程合同和大多數以提供服務為標的的合同;
原則上，合同的終止只能適用於非連續性合同。
